damaged

got a phone call on the golf course this aft informing me that some old bat had reversed into my FF Surprised Sad Mad ! so it now needs a new OSR light , new back bumper , parking sensor , rear valance , thing is it was a cat C 3 years ago and on an 2003 reg it will be touch and go wether they write it off again as we all know how much parts for our cars are and by the time labour is added It maybe un-economical to repair in the eyes of her insurers , im going to be royally ****** off it that turns out to be the case Mad Mad Mad

I take it that you’re familiar with the process of accepting the insurance company’s payment for the write off, buying the “wreck” and then paying to get the repair done sensibly, without using a lot of, usually largely unnecessary, new parts?

As it’s the old bats insurance who will have to pay and hopefully the old bat was delayed to get details?
The third party insurer have to return your vehicle to before the incident condition.
They cannot just write it off if you do not want them to.

if they deem it uneconomic it will be written off , the best bet may then be to buy it back and self repair

You can I believe negotiate a contract pay off with her insurance company and then repair it yourself thereby not writing it off -you would need to enquire from her insurance

time will tell guys but the parts are 770 quid inc vat and 400 to fit and paint ! so I feel beyond economical repair but of course as its coming off her insurance I maybe given the option of buy back plus settlement which im truly hoping for as I can get a bumper and rear light for less then 300 quid and fit myself and im still running around in him at the mo

I bought a cat d 206cc for one of the kids a few years ago but wasn't told at the time the boy had an accident even though was full comp no pay out as was a cat d . guy whom I bought off gone out of business so was down to bank of dad my thought for not checking I suppose !

are you saying you bought a cat d car unaware and it was subsequently in an accident and written off again and your insurer refused to pay out because it had previously been a write off?

if so who was the insurer?

As far as I understand it, her insurers cannot write it off without your agreement as they do not have an insurance contract with you. Your insurers could, but not hers.

Their liability is to put you back in the position you were in before she hit you so you should be able to negotiate a cash settlement and then arrange the work yourself.

Don't let them bully you into anything you don't want (they will try). Be reasonable and explain to them you want the cash to arrange the repairs yourself and they can't really argue with it. If they start to get difficult tell them you'll see them in court, that usually does the trick as they will always be looking for the cheapest way to settle.

They should also be offering you a car whilst yours is being repaired but that can also be part of your cash settlement. It's a numbers game with insurers.

thats because it is rubbish - if its uneconomical to repair they'll write it off thats the reasonable thing to do (even if your own insurance co. gets involved) , its up to the op to fight his case and most likely outcome is either a payment in lieu , or a buyback the salvage out of his write off money. a good example and possibly the only time this would be different may be if the op had something like an e type jag and his own insurance took on his case and fought his corner.

as this is a old ffrr [/u]the reasonable[u] thing to happen is the above scenario

The Third party (old Bats) insurer will either instruct one of their approved repairers to estimate the damage & authorise repairs, or settle on a cash basis (even if if it is a Total loss). The vehicle will remain your property, as the TP insurer has No legal right to your car.
The value will be reduced by the fact that the vehicle was a previous CAT C T/loss. Providing that there is No structural damage (sounds like there isn't) then they will either repair or write off as a CAT N T/loss, as all the salvage categories changed from October the 1st this year.
Do your research & get values of similar vehicle. Same age, mileage & condition.
They may instruct a Engineer to inspect, but the majority of inspections these days are carried by images. Either way you can get it repaired, although it now may have a CAT N marker along with the CAT C.
