JLR assistance said an engineer would be with me at 16:30 but turned up an hour late. There are too many faults to list so its back to Williams.

JLR Customer assistance have said they will call me at 8 to arrange a like for like loaner.

I want to reject the car as I think its a lemon. Its delivery was delayed due the car not taking its software. They had it for 5 weeks for a multitude of faults but in essence the car kept shutting down leaving me stranded. Now the same has happened. Do you think I have a strong case for rejecting the car?

From experience, yes, you have a log of all the dates and the system has all the warranty logs from job cards, either the dealer plays ball or straight onto the Finance company immediately, now they only have 30 days o resolve to your satisfaction, being a refund or a brand new car  Current vehicles

I initially thought of the Consumer Rights Act 2015, but your purchase will have been under the Sale of Goods Act on which there is commentary above.

I think that under both Acts, problems discovered within 6 months of purchase are deemed to exist at the time of purchase. After that it is presumably a case of having to prove that the fault existed at the time of the purchase, much more difficult.

If it is the same problem and the car was OK only for a short while before the problem came back, you might possibly be able to argue that the repair process which commenced when the car was 5 months old continues until now, with the dealer/LR having proved unable to cure the defect of 5 months ago (which would be deemed to have existed at purchase). I think that if you give them the chance to repair within the six months, you can still reject if they do not do so within a reasonable time and without significant inconvenience to you (the inconvenience angle is probably not much use if LR have been supplying a hire car) even after the six months have passed. There would be a case for getting proper legal advice if LR/the dealer are difficult.


Finally, I have a recollection that the LR warranty terms might say that if LR/the dealer cannot sort the (same major) problem in three attempts then you get a replacement car. Also, there is a chance of a replacement based on LR goodwill, given the age, price etc of the car, maybe with some contribution from you based on the use you have had. Involve LR Customer Relations if the dealer is not being reasonable.
