Having had a similar incident a few years ago i found the polar opposite. The person who is 'emerging' is automatically found at fault, regardless of what they might say, or what witnesses they have. If they've pulled out onto a main road or from a driveway etc, they're suppose to give way, if they don't it's their fault.

However this incident happened in France where the laws are different to the UK.

I rather suspect the main difference is that one driver is French and the other isn't Whistle

Bit like the UAE, the non-emarati is assumed to be at fault in all situations, irrespective of the circumstances. Got - 2017 SDV8 Autobiography in Loire Blue

same rules apply here indeed. did you takes pictures of the 2 vehicles on location?

For others : unless you are 200% sure not to be at fault (say you are hit from behind) do NEVER fill in a constat amiable in the rush of the accident as if you mess up a minute detail, it can do it be turned against you : simply give your details to the other party and take his/hers.

Then, once home, send you version of the events, you may use a constat amiable form or simply write a lettre. if possible, take pictures of the events too.

Constat amiable has no official value, it just help insurances gather your and their info ( a find a way to the the other party to pay)

'Facts' not in dispute - so it's over to the insurance companies to slug it out

I had the entrance directly behind me & the exit directly in front - it's a straight lane through the middle of the car park - I was clearly not going very fast - but obviously not slow enough

There used to be a restriction right where the picture was taken from that only allowed people through - hence the crossing - but that's now been removed and you can drive straight through - nothing to indicate he should give way.

Good pics, now the fact it is a private car parc will most likely mean 50-50 (this is how insurance deal with is unless you are static), to be honest this may help you as - you may/may not know - in France, traffic incoming from the right has right of way ("prioritée à droite"). So, you should have given him way since there are no Stop or Give way sign on the ground or posted.

Any trouble with the Frenchs, PM me and i will give you my details to help you this side of the Channel. if the damage is only a bumperskin, a wing and a light, check eBay and Dan for a quote as it may be more interesting to fix it yourself than using the insurance.

I'm fairly sure he'll be claiming, so it might as well go through the insurance - it's not just the repairs, it's fighting the liability.

I've got protected no claims & over 10 years claim free, so whist I accept there will be some kind of premium hike, it might as well be a claim and have the legal support of the insurance company.

Sorry to hear - I share your pain! Speaking from recent experience, the oil may well be from one of the intercoolers, which are located just behind the front bumper on each corner. If so, can I suggest that you remind them to check all the pipes, only it's turned out that mine has a leak that wasn't picked up until the engine started going into restricted performance when the turbos spin-up, over 2000rpm and then there is a pressure differential between the 2 of them and that's what trips the sensor.

Thanks - that sounds like it - it's a radiator right in front of the wheel & behind the bumper - hard to see from the outside as it's boxed in - I think wheel off & remove wheel arch liner is the only way to access it, but it does look bent from what I can see.

Insurance have OK'd getting temporary repairs done or even replacement part if I can source one.

LR Assist will recover the car to a main dealer but clearly can't confirm anything beyond that.

I also have RAC Travel Insurance who I haven't spoken to yet.

The main problem is the dog - if it was just people I'd have them repatriate the car & jump on a plane.

Still pondering my next move Confused

It lives right behind these bumper vents and there's a matching one on the other side -




I've decided to play safe & have the car repatriated - now just going through the hassle of sorting out the passengers - because that's the breakdown cover, not the car insurance Rolling Eyes At least I've sorted out a lift home for me & the dog, so the rest of the family can fly - I drew the short straw because I crashed the car Embarassed
