I was simply suggesting that the way to play this is sudden failure covered by warranty as it should be then everybody happy. No point in picking a fight if you do not need to that's all.

I tseem strange that the garage don't seem to want to carry out the repair and recover the cost via the warranty, even if they don't have a workshop, they normally have a deal with a local garage to do their pre sales work, etc.

Yes as I said I agree and SOGA is what it is but you do not get anything from the Citizens Advice Bureau apart from consumer advice. You have to go to court and prove your case to actually get money. It much easier to claim from the warranty the dealer provided! |

And "prove it was not" they they do in some cases. If a car has been independently inspected or a New MOT obtained its pretty strong evidence to a court that the car was as sound as can reasonably be expected at point of sale. I was just pointing out that a win is not automatic although the law is in favour of the buyer. I really do wish you the best. ![]() |

Garage has spoke to Warranty company who have said that for them to see if they cover it, diff would need removing from car. Completely dismantling and them then finding out which part is the issue. Said if its any part inside diff then it will be wear and tear. Garage said that's not practical so they can't help me and to tell garage warranty isn't worth paper it's wrote on! |

Typical. Basically an insurance policy, and we all known how insurance companies try and get out of paying. I had similar with a suspect head gasket failure. Was going to cost £700 to get the heads off at my authority before warrenty company waould pick up the bill for a head gone. Gaz - Yep, I was just trying to point out that the card are stacked in favour of the purchaser, but as you say it is not an guarateed win.

I don't think an unsecured bank loan would count as for the consumer credit act to apply it would need to be linked to the car, maybe worth contacting the bank and asking them.

Do you think any other damage could be done from there being no oil in diff? Wear on any other parts due to this? Extra strain on gearbox? |

Not defending the garage but I wouldn't check diff oil before I purchased a car and I doubt any garage would either. The thing that would concern me is if the garage haven't noticed a puddle or signs of oil leak then it might have had no oil for a while and may have caused other issues else where.
