Absolutely agree, he deserves a very severe punishment. I don’t see why the finance company should potentially lose out though. I always believed vehicles in finance couldn’t be seized. BMW i3 Electric Car

My limited understanding is thus: If a vehicle is uninsured, then the Police can seize it. If the driver is over the limit, his insurance doesn't cover him, therefore the vehicle can be seized.

I judge from this article that this is not the whole story.

Let us not forget that this occurred in Scotland. Different laws apply there to those in the rest of the UK.

While I agree drink drivers are loathsome, crushing perfectly good cars is just vandalism. |

If the vehicle is worth anything then it is sold, not crushed....

This is completely untrue, do you think if you're 1mph over the speed limit i.e. breaking the law you're not insured? The insurance company may (probably would) argue contributory negligence but you would still have full cover for third parties. and people that exceed the speed limit, have incorrectly spaced digits on their numberplate as well?
So you have your car in the garage for some work, the mechanic takes it out on road test and unfortunately he's over the limit from the night before, would it justified to crush your car? BMW i3 Electric Car 2012 Full Fat RR 4.4 TDV8 (now gone) 2006 VW Touareg 3.0 TDi V6 |
