Absolutely agree, he deserves a very severe punishment. I don’t see why the finance company should potentially lose out though. I always believed vehicles in finance couldn’t be seized. BMW i3 Electric Car

Certainly don’t condone drinking and driving but also need to remember Scotland’s level is much lower than in England. One pint could theoretically put you over the limit. Living near the border you can be legal here in England and get done over the border. Probably about 3 or 4 times over at English levels….still a very high reading.

My limited understanding is thus: If a vehicle is uninsured, then the Police can seize it. If the driver is over the limit, his insurance doesn't cover him, therefore the vehicle can be seized.
The Police have a duty to inform the ultimate owner of the vehicle, in this case the finance company, and the finance company then becomes liable for all costs and storage fees (which they then reclaim from the driver)
As a condition of finance is that the vehicle is insured comprehensively, being stopped for drink driving means that you have broken the terms of the finance agreement, and they will usually have the right to claim the full value of the car from you. Thats a car that you then have to try and get back form the police...

So yeah, he could well end up having to pay for the whole thing, and still lose it.

I judge from this article that this is not the whole story.

Under s.165 of the RTA a vehicle can be seized for no insurance or not in accordance with a licence. The vehicle is transported to a police pound where the driver has 14 days to reclaim it or it becomes the property of the force that seized it.

The vehicle could be seized under s.19 of PACE but that is pretty tenuous.

Police do not have a power of seizure for drink driving or drug driving offences.

Edit - Just noticed this appears to be Scottish so they may have different laws. I'm referring to the England & Wales.

When people go and buy a brand new range rover on finance for 100k but drive home under the influence, it will make them think is it really worth loosing this car. If they do and they get stopped, well 100k debt and nothing to show for it is a pretty big hit on the pocket as your still liable for the costs regardless who owns the car.

Might cause you some problems if your using a friend's car but it would be a big enough deterrent not to jeopardise your friendship

Completely agree Stan.

I've been there in both ends sadly. Not the drink driving but loosing a friend who was crossing the road and he got taken out by a drink driver and being the 1st paramedic crew on scene to what later becomes a fatal rtc of a child caused by drink/drugs.

Let us not forget that this occurred in Scotland. Different laws apply there to those in the rest of the UK.

While I agree drink drivers are loathsome, crushing perfectly good cars is just vandalism.

If the vehicle is worth anything then it is sold, not crushed....

It is nothing to do with Police seizure, the court seized "his" property...

I imagine the solicitors are making money, how can the court seize something that ultimately belongs to the finance company...
