Builder Damage - Insurance job?

Hello

Back in March my Range got splattered in cement from next doors builder.
Annoying enough but then he tried to wash it off with his builders bucket and
The bristle brush head from a broom! Felt he was doing me a favour apparently.

Car had multiple scratches down side and bonnet and would need machine polishing.

I had a polite word and he agreed to put it through his public liability insurance.
Chased him a couple of times but nothing and though he was just stringing me along
Hoping I would go away.

Yesterday nearly three months later a letter from his insurance asking for quote details and
Pictures etc 1st I had any idea he had spoke to them.

Only problem is I traded the car in a couple of weeks ago so no longer own it. Is the claim
Now dead in the water? I feel I got less for the car in trade in due to the body work so I am out of
Pocket. Also if they had rang me within a couple of weeks and said they were dealing with it I may have held
Onto the car longer to get it done.

Any one know if I can still pursue the claim and state my car was worth what it was minus a professional
Machine polish etc?

I have pictures of cement and damage and a video of him washing it from my door bell
So have all evidence I need.

I think if you still had the car, you could claim for diminution, but as you've now sold it and accepted the loss, I don't believe there's anything you can do to claim retrospectively.

I think you are sunk here. You cant show them the damage as you dont have the car anymore. you dont have any receipts for fixing the damage, nor can they get it fixed own your behalf.

Had you repaired it before selling it and kept the receipts, you might have had a chance, but it's impossible to quantify what the potential loss was at the point of sale. These are insurance companies, if you cant assign a precise value to it, you get nothing.

Thanks for your replies.

Just feel that due to the time it has taken to acknowledge the claim is unacceptable
And if it was done within a reasonable time the claim would have happened. I owned the car when the damage was done
And feel out of pocket. Why should I lose for their slowness and the builder gets away with
Damaging my car.

Just doesn’t seem right.

IT seems you've figured out why claims take so long. It is in THEIR best interest...
Sorry to read about it all.
I gather it's time to cut your loses and move on. We've all been there. This is not worth you thinking it over too much now.
Did you replace it with another RR?

It was a toss up between an L405 or a BMW M4 Comp. the M4 won as it may be the last time I get to own
One before the world goes milk float!

Will be back in a Range as soon as the plug in hybrid becomes affordable.

Can you get it in writing from the purchaser that they paid £XXX less for your vehicle due to the condition of the paintwork?

If you can, this should be sufficient evidence of the loss incurred and you can claim for this loss.

ETA- I still think that you a have a strong case, even without the above, due to having the photos and video, plus his admittance.

Sorry to hear about your issues. As others have said, as you no longer have the car, you can't produce evidence of a loss.

I had a bit of advice from a loss adjuster friend many years ago, which I have followed since when making a claim against someone else's insurance. What he told me is that you are the claimant and you can't rely on the other person to make the claim on your behalf as they are the insured, not the claimant.

Now, my first words to anyone are "insurance details please" which means I get a bit more control over the issue. 2021 D350 Fifty Edition

Borderline fraud, but as long as you read & word everything carefully and don't claim to still have the car....

You can still supply the video as evidence to the insurers.
You can probably get a quote to repair the damage from a detailer by providing the same video.

You may not get a cash settlement though.

Actually do. Remember this is not an Rta.

The evidence of the loss would be the photos of the damage and video of him causing it.

All I can do is contact his insurance and explain the situation and see what they say.

All they can say is no I suppose

Well I spoke to them today and they have said I should still have a claim due to having to take
A reduced trade in on mine. I have quantified this as the cost of a professional machine polish.

Have emailed it all over so let’s see.

I don’t know how much you hope to get out this but have considered the potential for loss of NCD?
How will you answer the question “have you made any claims regardless of fault?”
Personally I would forget all about claiming for a perceived loss of a few £

This has nothing to do with car insurance or no claims bonus. This is a builders public liability
Insurance. It is no different to him damaging your property it just so happens that the property
Was my car.

Insurance is insurance and everything is stored on shared databases, I expect a loss adjuster trying to avoid a future claim might have a different view to you.
It just seems like a bit of a risk for what is a pretty insignificant amount of money in a case that is not straightforward.
