I agree with the general sentiment. It would have taken the man less time to answer your questions than it took to write what he did! And the point about how he would react to after sales issues is very valid.

Not entirely true: even a private sale carries some rights which are protected legally. It has to be yours to sell; you are not allowed to misrepresent etc.
Granted the rights are fewer and any recourse more difficult, but my point is that there are certain legal thresholds even a private seller must meet. This is strengthened when buying from a retailer, especially the quality and condition aspects... or any faults which may have been pre-existing, before the sale (unless they were disclosed and/or the purchaser waived rights, as in a so-called ‘trade sale’).

Also, rights aside, some sellers make you think there is more likelihood an issue will occur, whether they will deal with it nicely or not.

When I’ve sold a car I’ve not had any issues with giving extra details about a car
I like to think I’m probably a bit too honest onto no6 Range Rover

I don't want to put a direct link to the advert, but it's a 2010 car on for £8500.

I've not heard anything back from the seller since my last message but think i'm going to try and stretch to a 4.4 instead of the 3.6.

Whenever I've sold any vehicle, I've always been very clear that it comes with no warranty or guarantees. But I've always been at great pains to point out any issues I know about -even when doing part ex with a dealer. I try to be as honest as possible. I also mark the receipts with "sold as seen, tried, and tested." I thought that placed the responsibility on the purchaser to fully test before handing over the cash and exempted you from any comeback? Even the very best vehicle could theoretically chew its cambelt 2 feet off your drive? Does anyone know if there's any truth in the sold as seen statement? FFRR 4.2SC/KTM 990SMT Current and cherished.

This is according to the AA when buying privately

The only legal terms that cover a private sale contract are:

The seller must have the right to sell the car.
The vehicle should match the description given by the seller.
The car must be roadworthy – it is a criminal offence to sell an unroadworthy car and an MOT certificate from a test several months ago is no guarantee that the car is roadworthy today. 2011 TDV8 Vogue SE

I generally agree. The “sold as seen...’ I think is more aimed at condition and any unspoken implications. It cannot cover things that would be illegal to do/not do, as no contract can cover things that are not legal. So if you say it’s a 2010 vehicle but it’s actually a 2007, you cannot simply disclaim this by an agreement. You would need to explicitly rescind the statement.

At least I think so...

when ever i sell on ebay i always go to great lengths in the description. if it failed an MOT or had advisories on it i state if they were repaired or not and make sure i have invoices for parts & labour (If i did not do it myself)
If i am buying from Ebay and got a response to my questions like that i would just walk away they are more than likely trying to hide something. 2012 Vogue 4.4 TDV8 - Current
