Roofers and small claims court.

Right need a bit of help.
My i laws have just had their garage roof replaced but unfortunately not to the standard req. The had their quote which was £1750. The roofer wanted half the money upfront which I told them to refuse as it as a relatively small job. They were taking the old tiles off and keeping them as part of the deal to recycle. Now the quote was to replace the roof and included fascias and soffits. I went round yesterday to see them as the roofers had "finished". The dive was fill of sacks of Censored and they hadn't put the lead flashing to where the roof meets the house Shocked . They told my father in-law they would be back today to pick up the Censored and hey would come back and do the lead work but it would be about £250 Shocked When questioned they said it wasn't included in the quote!
Now he's going to give them a call tomorrow and get try and get them back but unfortunately he has paid them in full which he was told by me and mother in-law not to do. I have a strong feeling he won't see these lads again and will have to splash out to get the lead work done and get a skip to remove the Censored at his cost. This guy is going to get one chance then I'm getting involved, with the plan to take him to a small claims court plus IRS if needed to try and get the job gone.

Has anyone ever had a roof replaced and the roofer never quoted for lead work BUT fascias and soffits?

What is the process for taking someone to a small claims court?

Ok. It is quite conceivable for a roofer to exclude lead work from a quote. Traditionally (especially on something like a valley) lead work would be done by a plumber.

Unless you can prove it is custom and practice you are wasting your time.

As for courts, you, as the claimant have the burdens of proof and process. 90% of small claims are decided on a point of law, not a point of principle. You would be much better off getting Trading Standards involved.

Mzplcg is on the right track here...you'll have a hell of a fight on your hands which will more than likely cost you more than the £250 quoted to do the work regardless...

I see your point, but without a fully itemised quotation you'll be struggling to prove anything. Probably best to take the £250 hit now but be sure to get a fully itemised quote based on a documented detailed scope of work for anything in the future.. '08 Audi S6 Avant 5.2 V10 with Milltek non-resonated. ok thanks. The lead work is the flashing between the roof slope and the main house wall. As it stands rain/water can just run down the wall and into the garage. They have added what I now know to be ldad soakers but no flashing over the top to weather proof. surelh this should be done as a standard practice for replacing a roof? [img]http://www.fuelly.com/driver/rob2529/range-rover[img/]

OK, generally speaking you are unliukely to come across a situation where lead flashing would not be needed if you have a standard sloping roof which butts up to an outside wall. You "might" be able to argue that on the basis of it not being fit for purpose, i.e. they fitted a roof which is bound to leak.

But, unless you're very good at contract law the courts are not your friend. You can have right and justice on your side and still lose on a point of law. Go to court if you want but I would be a month's salary that you lose, honestly.

Seriously, get Trading Standards involved. They know how to deal with this kind of thing; it's what they do all day long.

Sorry miss understanding here. I've packed in the idea of court on what you have said. I was mentioning the above to try and attain if the roof should have flashing or if we're being stupid about it. I've just checked the emailed quote and it states re Tile the roof and replace lead flashings to gable end along with removal of all rubbish.

He has used the correct soakers, but obviously its not water tight without a flashing over the top.

If the quote says lead flashing, ask him why he thinks its finished.

Whats the over hang like into the gutter, in the pics the tiles look a bit short?

^^^^ As above definitely needs a lead flashing with a good upstand fitted to fully water-proof.
I would also question why the roof felt under the tiles wasn't replaced along the bottom edges and dressed into the gutters.

Having built a few houses now myself (its my job after all), all the above comments seem fair, the overhang at the eaves seems small, the felt should be dressed into the gutter and supported using a proprietory eaves carier as recommended by the breather membrane manufacturer.

The verge flashing seems very shallow on the upstand and looks odly like plastic in the pictures. Check to see if a saddle piece is fitted at the top under the ridge dressed up the wall, if not it will leak there.

It looks like the roofer was looking to use the existing groove in the wall for the cloaking strip, this would be fine however if i were doing it i would like to see a larger upstand on the soakers and at least 100mm upstand of lead. (Cant tell what is there from the pic)

While it is true that it is a plumbers job to do flashing of gutters etc, on a job such as your garage i would have thought it would be appropriate for the roofer to carry out the whole job.


If the work was included in the original quote it is definitely not unreasonable to expect it to be completed. Set your case out to him with reference to the original quote, in writing in a calm and collected way, and see what his response is, enclosing a copy of his original quote. No threats or acusations.

If he will not comply then up the ante with reference to trading standards.

And if there is still no compliance then report him, and take him to small claims. If you have a written quote detailing the works to be carried out and the price to be paid....... There is nothing that can't be fixed with a hammer😜😜

Thought as much. Glad to know we're in the right. When you say upstand do you mean the height from the tile up the wall the lead should go? Can you explain the bit about the ridge peak a bit more? Is there anywhere that I can see a building standard for the likes of the felt overhang and lead heights sizes etc? The more you guys mention the more I'm questioning the standard they have worked to. Yes, the height up the wall of the lead.

In terms of the saddle, where ridge of the roof meets the wall there should be a piece of lead fitted under the ridge tiles and dressed over the tops of the top tiles (like a saddle on a horse) then a bit up the wall. This stops any water seeping down the back of the end ridge tile into the roof.

There are instructions for the felt on most manufacturers sites IKO is one of the bigger mfrs, along with kober this will give the eaves details. Though recommended by the maufacturer many roofers i have come across do not fit an eaves carrier and simply dress the felt into the gutter, this has never created a problem for me.
