Refundable deposit problem on non existent model

Mainly having second thoughts about this new RR L405 , so a few months back i put down a deposit on one , the other week i phoned the LR Dealership to enquire as to getting my deposit back as the salesman said i had up until a certain time .

So on phoning , spoke with their accounts dept who in turn put me on to their sales manager who then told me "since this is a deposit for a forthcoming order the deposit is non refundable" to which i replied "but Land Rover have not even designed this model yet so how do you work out it's for a forthcoming order "on asking for the DP i was told he was on holiday and that i would have to be referred to him with regards to getting my money back ... Rolling Eyes

Did you sign anything with them ?

Many car order contracts do say if you cancel you'd loose the deposit.

@Fox , No didn't want to be first owner of one , as that would be near impossible , just put the deposit down because i thought i would really like one.

@johnson1 , Mostly after seeing recent spy shots and reviews in the press plus the recent spate of problems the 4.4 TDV8 has been having.

@Rolo , No nothing was signed i paid over the phone by card .

If it was a credit card & the dealer won't refund, I would get onto your card issuer to do a charge back.

As there's no paperwork / signed contract I see no reason why they couldn't do that for you.

The dealer would have to be a real arse if they don't refund you in this instance, cause the amount of bad press they could get as a result would not be worth it - just remind him of that when you speak to him Thumbs Up

If you'd signed a contract & delivery was on the cards for 'x' months, I could understand them not agreeing, but as it's for something not even made, no way ! They wouldn't probably even have booked manufacturing space for those yet................

Did they quote a final price you'd have to pay ? Not sure how they can really take a deposit legally if they haven't................

Ask James at Lookers what he/they think but as its a non specific deposit with no agreed price or agreed delivery date I think they should refund it.

Different storey if you had actually ordered a car on their system and it was in or near production. Surprised

You mention issues with the 4.4 TDV8 ? not heard of any and have 3 pals with 4.4's as well no issues ?

What issues are you referring to ? Far to many gone...

That is not to do with the 4.4 its all the FFRR that have had a recall to change the batts and software.
Mine has had no problems , but i know 1 guy with a 5.0SC that has had battery issues.

My 3.6 RRS has had the same batt problem Far to many gone...
