Its a big subject, too big for forum debate and one best left to lawyers. There's an interesting forum topic here on it. However, in synopsis, protections for aftermarket manufacturers exist in law to prevent OEMs profiteering in a closed market they have created. Small plastic discs at £40+ are an excellent example of why the aftermarket does and should exist. And the fact you can buy badges, keyrings, wheel caps, light units, grilles, brake pads, exhausts and all manner of things aftermarket demonstrates the ability to do so legally. Were that not the case, the likes of Britpart and Powerful UK wouldnt exist. Some companies are more litigious than others. Dyson are known to be very litigious, for example. BMW are quite litigious also as you can see in this case where they sued an alloy wheel manufacturer, and in that case, won.
