Assuming you both agreed on the situation when the car was dropped off it must have taken place whilst the car was in their custody. Regardless of all other circumstances it is still their responsibility to take care of the car.

I had a very similar thing happen to me when I took mine to the main dealer for the brake hose recall. Mine hade a chip on both offside doors and on the side of the bonnet.

i am not going to name them just yet as it looks like they have taken it in , it all now depends on what sort of repair they are willing to do |

update.......just got off the phone with md and they have agreed to do the repairs,nice bloke started to say he was going to do a smart repair to the paint work but thanks to stuarts post/reply i soon put him right about that. its going in for two days on the 6th december i will keep you posted.and thank you to mzplcg for the letter template hopefully i will not need it |

Thought I would give you an update, main dealer have taken responsibility and powder-coated the wheel and also repaired the scratches, all the work they said they were going to do was done quick and to an exceptional standard, fair play to lookers in colchester. |

It's not really though, is it? They should have contacted you as soon as they knew they'd damaged it, apologised profusely and given you an equal car to use until they had repaired it properly at your convenience. Mistakes happen, it's how they are dealt with that sets the good aside from the bad. This was bad, you should not have had to fight to get this done. Tells me a lot about the possibility of a culture of fear on site amongst the employees who may have been too frightened to report what had happened.
