Hi All

On my way home from a 5 day break in the Lake District I was approaching a slip road onto a motorway and a delivery van for a well known supermarket with 4 letters in the name was coming the other way, he was indicating to enter the same slip road as me. The junction onto the slip road was triangular, my entrance one side, his the other.

I checked I had right of way and pulled across the lane to enter the junction for the slip road only to find he wasn't going onto it, he was going straight on and I pulled across him. I was a fair few meters in front and was on the slip road in time but only because he saw me and braked hard to avoid a collision.

I went past and he came to a stop, but I had my 10 month old with me so I kept driving, no way was I getting into a row about it with her in the car. A very lucky escape that has bet bugging me ever since, I know he was indicating, my missus saw him too, but he clearly felt I was to blame judging by the amount of time he spent honking his horn.

No accident occurred thank god, but should I log this with anyone, Police, the supermarket etc. or just forget about it? Got visions of getting a letter in the post or something, even though I wasn't actually at fault. My daughter was on that side of the car, no f***ing way would I chance darting across, it wasn't a busy road, I had nothing to gain.

What would you guys do?

I maybe wrong but if you pulled across him even though he was signalling, it is you in the wrong
In the event of an accident it is going to be his word against yours as to whether he was signalling or not
At least nobody was hurt

There is nothing for you to do. There was no collision and no one was injured (obviously you were shaken). I doubt he would try to take any action. You have witnesses that he was in the wrong (he may have later realised he had his indicator going).

Even if he were to make a complaint to Police it is very, very unlikely they would follow it up.

Chalk it up to experience and be glad that it was no worse than that.

As I said in the extremely unlikely event of you being approach you have a witness in your wife.

If it helps you about it, both of you make a note of what happened - day, date , time and place etc - and keep it for insurance.

Enjoy your motoring and remember everyone else on the road is an idiot and drive accordingly.

PS. I disagree with Babagee about you being in the wrong. For example it has been held that if someone is approaching a junction from which you are about to pull out and they are signalling to turn into that junction but continue on then they are in the wrong. The signal makes it a similar case. John

Thanks for the comments guys, he was signalling, 100% sure about it. No impact, just very luck for both sides, the speed limit was 40mph and I think us both doing that saved the collision.

His signalling made me pull across, had he not been Id have waited to let him pass me, hopefully he's a decent bloke, realised he was signalling and that's the end of that.

be aware that an indicator on another vehicle may not have been cancelled.

Hence my comment about treating everyone else on the road with circumspection.

He deffo hadn't cancelled it, no collision just plenty of swearing, from both I'm sure, lets see then.

Just to add, when I moved across, he was still at the point where he could have gone onto the slip road, I didn't know he wouldn't, its not like he had passed his junction and I cut him up.

Maybe I should have assumed he was not going to, the gap between the junctions and our speeds saved an accident.

As far as I understand it, it doesn't matter whether or not he was signalling. If he had hit you, it would have been seen as your fault in terms of Insurance blame, even if his indicators were flashing. you crossed his path. He shouldn't have been signalling, but more importantly you should not have pulled out until you had see him position his vehicle to definitively take the path into the slip road. Sorry...

I didn't intentionally do it, as I'm sure he didn't mean to have his indicator flashing, thank god he didn't hit me, my daughter sits on that side of the car.

Nope, you don't have to do anything, just one of those things. Nothing to report, no collision, no damage, no injuries. Don't have to report an almost accident, to either the insurance companies or the police, Its very unlikely he would take it any further, there is nothing to claim off your insurance for and at the end of the day I'm pretty sure the police have better things to do than come and tell you to pay better attention.  There is nothing that can't be fixed with a hammer😜😜

The only thing you can be sure of when you see an indicator flashing is that the bulb works. Chalk it up to experience and move on. letters not necessarily in the right order

Without wishing to trivialise what was clearly a traumatic experience, I'd have a glass of wine and forget about it

Thanks everyone, it was s shock, been driving for 25 years and never come across an incident like that before. At a roundabout or junction I would always wait to be sure, this one caught me by surprise big time, I genuinely expected him to turn up the slip road like me.
