A mate of mine was at An Aldi yesterday day and a new range silver rover pulled in and parked at the doors on a double yellow line. A delivery wagon could not get access so asked him would he move and got a lot of abuse and basically said no its staying where it is at.
So the wagon driver had a few goes at reversing in to unload and last go he took both doors and rear quarter out and a window and damaged door pillar.
He said the driver said you are on private land and its down to you it got a bit heated so my mate left.
BUT WHY SHOULD A PERSON WHO CAN AFFORD A NEW RANGE ROVER WANT TO GO AND SHOP AT ALDI
Whats your views lads, my mate wanted to take a photo but he said it was not worth the hassle.

If it's private land, to which the public had access at the time, then it is covered under the road traffic act 1988 and you need full documentation and any accident is considered as the same as being on a road...

If the lorry driver couldn't complete his maneuver without hitting the FF then he should have waited...

If the FF driver hadn't had his head up his then he wouldn't have all the hassle...

But I have to agree if I could afford a new FF I'd have a little man to do my shopping.....!!!! Pete

Whoever owns the Range Rover is exactly the sort of arrogant person who reinforces the negative stereotypes of Range Rover drivers.
Why on earth would you not exercise a little courtesy and move your car so that the delivery driver could do his job?
Looks like natural justice does exist. RR driver got what he deserved. Travelling around in circles again.

If I thought someone was going to attempt a manoeuvre like that near any of my cars and I had the chance to move, I'd be out of the way quickly.

I wonder if the RR driver will tell his insurance company that he came back to his car and found it damaged without any idea how it happened?

If the range rover was parked on double yellow lines at the time, then that would be a different matter. The RR driver could be done for causing an unnecessary obstruction, fault would lie squarely with the RR driver and not the wagon driver.

Sad that one arrogant RR driver gives the rest of us a bad name, so I'm afraid to say it's his tough luck!

imho A, the arrogant RR owner should have moved it... BUT there are a lot of arrogant lorry drivers out there too! so B, the lorry driver should have simply waited... Be the bigger person! Turn the other cheek! I guess he could be verging on a criminal damage charge!

Don't agree Craig. Lorry driver was working, probably delivering to a schedule. Any delay would have a knock on effect to subsequent deliveries which would then inconvenience many others.
RR driver was shopping. The delivery driver was working. In my world working trumps shopping. Delivering goods for a larger group trumps individual arrogance.

Working trumps shopping unless you are a woman.  Travelling around in circles again.

eat baked beans and brussel sprouts and you will trump everything...

Didn't want to go too much into this but...

from the Criminal Damage act 1971

A person who without lawful excuse destroys or damages any property belonging to another intending to destroy or damage any such property or being reckless as to whether any such property would be destroyed or damaged shall be guilty of an offence.

If the lorry driver asked the guy to move the FF because he couldn't park without hitting it and then, for whatever reason, he completes the maneuver and does cause damage, that is a reckless act and there is sufficient evidence to arrest him....

You can tell what I used to be.... if I'd been called down to this then the lorry driver would have been arrested for Criminal Damage. He has shown he knew he would cause damage if he completed the maneuver and did it anyway.

The FF driver was a but that doesn't mean you just carry on regardless, the lorry driver is a professional and should know better...

If the FF had been on a road and parked on double yellow lines it still makes no difference, you can't go round damaging peoples property just because they were doing something they shouldn't be.

If, as it shows, the FF driver was committing unnecessary obstruction and the lorry driver had called the Police and the FF driver refused to move when asked, he is then causing Willful Obstruction which has a power of arrest attached, so, the lorry driver should have called the police and let them deal with it....

Of course you are up against the fact that there are so few policeman left these days, due to budget cuts, that you are unlikely to get one anyway..... Pete

Whatever anyone feels or thinks about this the law is clear, as will be the insurance company view, and presumably that of the delivery drivers employer.

The parcel I have been waiting in for all day has now arrived - late. The delivery driver was blocked in at his last delivery by a BMW X6. Unfortunately the X6 escaped without a scratch Anyway no more posts from me today. Got to get on.  Travelling around in circles again.

Have never and will never quite get my head round the appeal of the X6
