Terrain Response & emissions testing

In was reading something on the sister Disco3 site and it got me wondering -

Does the government emissions test have to be passed by a new car in any setting it can offer? If you put terrain response into sand mode the throttle is much more responsive and yet if it still has to pass the emissions test for type approval in this mode why not make the standard mode more responsive?

Just idle thoughts that aren't going to change our world but I'd still like to know the answer.

Pass in any setting? I wouldn't like so. If yes, the car would need to pass in "Access" which it is clearly not designed to do.
