9 days TOIL in 3 months sounds a lot, but it's really only just over an hour a day and if that's mostly made up of time spent travelling, then I can see why the company is not really willing to compensate for it. Cost cutting and efficiency is the current fad and everyone seems to be jumping on the bandwagon at the moment and its little things like these that are easy targets, especially if its a perk rather than a contractual requirement.

Does your contract state that all overtime is paid or given back as TOIL, or does it state that occasional overtime is required and won't be compensated? If not in your contract, is there anything in your detailed job spec/description that mentions working overtime/travel requirements?

I'm not criticising your approach, and if there are other opportunities just as close by for similar work/pay then it makes sense to look elsewhere, but if not could the alternative turn out to be worse? After all, the grass is always greener and with <2 years under your belt you don't have the safety net of a redundancy settlement... '08 Audi S6 Avant 5.2 V10 with Milltek non-resonated. yip, that's my 7.5hours and 30mins lunch, which I invariably end up having at my desk and working it anyway so even more time they get from me Smile

It just really gets my nose up as i haven't asked for any toil for the rest of the year when i have done things like work straight thru the night, bar a 30min nap on the floor while rebuilding a failed server and early sunday mornings work on live environments to get things done.

This weekend i did 14hours, about 9-10 on one day and the rest the following day o get things done but made sure i got emails saying i would get it all back as TOIL, but have already said im booked up at the weekends and evenings for a fair while now so wouldn't be doing anymore things like that again Smile

Someone will realise at some point what call they have made and ask for provisions to be made or realise when to late as im possibly looking at going back to the lovely public sector or contractors for the pub sector now all the contracts are being pushed out from central procurement office place to smaller companies seems to have created some more requests for SC/DV cleared people so a bonus for people like me even though i only have a few years of validity left it could work out well. don't know if this helps but my contract also has similar wording. I've got the contracted hours and salary, and place of work, but with wording saying something similar to "you may be asked to work more hours from time to time without overtime pay" but no other indication of what time to time means.

however, in my industry, this is accepted as pretty much being whatever extra work is needed doing for clients outside of your normal hours, be it 1 to 2 hours to 110 hour weeks if work requires it. I am based in a single place 99% of the time so can't comment on what the deal is on having to visit client sites, etc. but when we do go to clients we normally have expenses covered by charging to the client so I normally recover those costs.

so I guess for the extra hours you put in, may be worth comparing against what is established practice in your area of work and see if this is normal? MY11 Vogue 4.4 TDV8 - "African Queen"
