SAXTON 4 x 4

Has anyone else bought a death trap from this company? I have! Don't ever purchase a car from this company they are awful. Sold me a car with 2 different size tyres on the front that had a brand new MOT, then I find that the offside rear tyre has gouge half an inch wide round the inner wall. They sorted the new tyres out, but refuse point blank to take responsibility for the damage on the rear tyre. NEVER BUY A DEATH TRAP FROM THIS COMPANY!

I don't think you're the first to have trouble with them though others have had more positive experiences. They're quite near me so I did look at their "stock" before buying elsewhere... Graham

The tyres tho'.... You should have checked them before you bought the vehicle. That's basic. Previously..

Ok I would check the tyres when buying a car - but anyone could buy a car and many people have no idea about tyre sizes and would expect an MOT to protect them, never mind they're going to a garage to get piece of mind rather than buying privately.

Was the MOT done my them?

Consider contacting VOSA ref. the tyres.
If the car passed in the condition you describe, the test may have been fraudulent.
VOSA will be interested if this is the case. There is information on how to do this on the dot gov website.

Also, if you are so concerned you could get the car MOT'D again. I'd recommend taking it to a Local Authority MOT garage - they don't want to make money out of you (I'd recommend that to anyone . . . )

I was considering travelling to these... until I read the interesting items on here regarding there lemons....... I also put their name in Google and other reviews convinced me to move on.... also good reading..... Glad I didn't travel over 300 miles..... Thanks again to this well informative forum......

Brother in law bought a RRS from them , total lemon

Good mate bought an SL 55 AMG , was basically impounded by Merc dealer during a routine visit for
dangerous faults . Was. £4k repair to active suspension , he threatened them with court, they laughed at him ...

There is more to the story than meets the eye. I did inspect the car as best as I was able but unless I had the opportunity to inspect the car on a ramp, I would never have been able to see the damage. Furthermore, they say that when they had the car back to change the "wrong" size tyre that was fitted on the front that they would have checked it again which they obviously didn't. The car is under warranty and there is no way that the tyre could have been damaged when fitted to the back of the car.
My point is, that this is such a dangerous fault that they should have checked it better, and at least stood by there warranty policy. Further more, it is the responsibility of the seller to sell products that are in good condition and fit for purpose and this obviously isn't.
They really couldn't care less about customer service.

Hindsight is great but when you're buying from a larger dealer, it's not unreasonable to expect them to do things correctly and treat you properly, even if that turns out not to be the reality.

Sale of Goods Act 1979:
Sections 14 and 48 of the Sale of Goods Act 1979 relate to the fact the consumer has a right to expect quality, fitness for all the purposes supplied, freedom from minor defects and a reasonable expectation for repairs to have been undertaken within a reasonable time without causing significant inconvenience. If these things are not the case with your purchase you can assert non conformity to the contract of sale within the period of six months from the date of purchase.

As mentioned, if you're not confident about the state/ fitness for purpose of the car, you could have a second MOT done or perhaps even take it to a recc' indie specialist and ask them to do an inspection report which will either give you peace of mind or a list of snags to return to the seller with to address under warranty, via goodwill and/ or so as they don't contravene the S of G.A.

Thanks for all the support and advice guys. Very interested about the comments from Craig. Is there a known defect with these type of tyres as your 100% correct on the tyre type/size. The car is an Overfinch Aero 3 2008 Petrol.

I naturally presumed that the tyre had originally been fitted to the front of the car before the bottom suspension arms had been changed, and during the time they were worn out this had led to the steering being able to "over centre" and cause the inner edge to fowl on a bolt head or similar protrusion.

Sorry to be bearer of bad news , but these guys have seen it all before.
Be prepared to swallow it and move on, my mate threatened them with court, trading standards , giving the car back .. You name it Big Cry

They don't care . Ask yourself why are they all over internet? No interest in rectifying issues. Alcohol and eBay is never a good mix

UK Consumer Rights

My understanding of UK consumer rights/ here are some options/ considerations if things are not going as you would have hoped:

References to ‘caveat emptor’, meaning ‘let the buyer beware’:
If you buy a car from a *private seller* , 'let the buyer beware'. You have fewer legal rights, so make sure you inspect the car and know what you are buying. You will only be able to claim against the previous owner if he/she lied, for example about its age or mileage. You will not be able to claim where there are faults with the car.

However, buying from a motor trader (or dealer) is a different matter and you have greater rights -

'Wear and tear':
A seller is not responsible for fair wear and tear, so you cannot claim goods are unsatisfactory just because they've become a bit worn over time. For goods to be unsatisfactory they need to be faulty when you bought them, even if you didn't discover the fault until later. If the goods don't last as long as they should, this suggests that they were faulty from the beginning.

If a defect is detected within 6 months, it is presumed that the defect existed at the time of sale or delivery, unless the seller can prove otherwise.

Whilst better to do so, you do not have to examine items before buying them. This means that if you haven't spotted something wrong before buying an item, you can still claim it is not of satisfactory quality. This applies even if you would have spotted the defect if you had examined it closely. However, if you don't complain quickly, you may have to accept a repair, replacement or partial refund, rather than a full refund.

All perhaps easier said than done if a dealer is hard faced and 'isn't bothered' but if you feel you have a legitimate grievance and feel it's worth the bother, if you don't pursue it, nothing will change.
