INTERMITTANT GEARBOX DEFAULT

Hi all. Advice and opinions sought for this please; I have a lovely '04 L322 V8 petrol, Epsom GREEN WITH Ivory leather. Had gearbox refurb'd late last year and is still within it's 18 month / 18000 mile warranty - total mileage today is 114,000 miles. The refurb has completely cured the problems I was having, but, just three times this year it has defaulted to 2nd gear. It was always when the weather was hot and invariably almost at the end of the long journey I was on (not that the car knew that) and therefore the running gear was hot. I have returned the car to the refurb agent who had it for the weekend but could not replicate the problem. I need to add, that once I stood the car for upwards of 30 - 60 minutes (a typical business appointment duration) it drives faultlessly! The agent has said it sounds like it needs a new transmission oil cooler as he's only ever seen one similar problem where the cooler was choked with crap and a replacement cured it.
whilst it makes sense to me, does it to you? Your valued opinions would be appreciated.
Unrelated matter; as RR uses the Jag 5 litre supercharged lump, whose was the 4.2 previously used?

a) Change the cooler or get the garage that should have change/cleaned it to do it.
