as the car is on finance they cannot legally sell the car as they are technically not the owner

the deal is they phone up and get a settlement figure, either clear the finance and sell the car or i offered to clear the finance and give them the difference in cash
they owed £16k on finance and did not have the money to pay the difference between whet i agreed and the £16k
so now the only option to them is keep the car and keep up the payments or let the finance company repossess the car if they cant afford the repayments.
when you HPI a car ..... which i should have done before traveling they will tell you finance is owing but not how much.... data protection i think.

i will be more careful next time before i travel

i read a case years ago where a guy advertised his car for sale with finance owing ( cant remember how much but say £10k)
the buyer agrees a price ( say £15k) agrees to pay £5k to the guy and £10k to the finance company.
the buyer pays £10k to the finance company prior to paying the seller. and gets an email from the finance company saying that the car is now clear.
seller changes his mind so now has a clear car
police get involved but class it as a civil matter so buyer has to take seller to court for the £10K ( which he doesn't have)
I know what i would do but your still £10k out of pocket

Always best to be in possession of the car before clearing the finance. Also make sure you have spoken directly with finance company to check that the balance is correct and that a payment from 3rd party is accepted.

Ah, that clears it up. I never financed a car in my life (nor do I plan to ever do so) so didn't realize that the finance company actually owns the car. I wonder if leasing wouldn't be a better option in that case ?

Just a quick point to be very aware of regarding getting a private sale HPI checked

I'm sure we've all seen the 'logbook loans' adverts at one time or another.
Please be aware that most of those companies do NOT register the loan with HPI, Experian, DVLA, or any other agency, so there is no way of checking if the car has a logbook loan outstanding.
However, if you buy the car, the person stops the payments, next thing the loan co. turn up and repo the car from you. Entirely legally, too.
Best way to deal with this is to write up a declaration, and get the vendor to sign the declaration stating that there is no finance of any sort, including 'logbook loans' or similar, that is owing, and that they sell with 'good, full and unencumbered title'.
At least then you do have clear evidence of fraud, and even if you lose the car, you may still have some satisfaction from seeing the vendor heading for the cells.
The above would not apply in any sale from the motor trade to a private individual. The trader sells to you warranting 'good, unencumbered and free title', so you are fully protected in the event that they have been sold a pup.

Another way in which buying retail gives additional safety.
