Go for a drive in one and if it changes from 5th to 6th it has an AJV8 2008 MY Supercharged

You can tell by looking at the engine IIRC. The BMW engine sits higher up and looks like this:

I should have pointed out that I knew what to look for under the bonnet. I'm well acquainted with the M62 from several BMW 540is I've had.

Or check the gearbox. 6 speed on the AJV8. 5 speed on the BMW unit. I think there may also be a very small difference in cc. Might show up on a DVLA plate check. Easier still all factory 2006+ facelift cars are AJV8 the "hybrid" Touchscreen BMW cars are all non facelift.
