If it's anything like my parents divorce then she'll get the option to buy him out of his half. However if they are still married then I'm not sure he can actually turf her out and sell the house.

Sorry to hear this.

I guess it all depends on wether your mum can actually afford to buy him out of his half, assuming the house/mortgage is in both their names.

I have a workmate who split from his wife (they're both in their sixties), he stayed in the home and she moved out into rented accomodation, then went to a lawyer to get him to pay for it! Being the bloody minded guy he is, he refused on the basis that she didn't actually have to move out. I do believe she was entitled to some form of "maintenance" as she didn't work or have any means of income except her pension. I'm sure there' some concept of "keeping someone in the manner they've come to expect" based on pre-seperation lifestyle, but how this works in reality, I'm not sure.

In the end they're now divorced and he bought her out of the house, albeit he had to forego half of his pensions.

I don't think he can just have her evicted, but if it's acrimonious, she might want to change the locks to keep him out. Seems a bit drastic I know, but when passions run high, people do stupid things.

As above it CAN depend on whos on the mortgage, IE if one is in before they got married and all and then it boils down to whos paid the most of the house off and then that relates to the chunk of the assets they get so she'd likely end up having to leave OR get a mortgage to cover the cost of the chunk she didn't own.

if they can have a decent talk and be amicable about it then it will be in their best interests. if not its a court jobby at which point i would advise her to be a LIP and save her self a shed load of dosh and just read up on the net about the irish law around it and see if there are any places that can offer advice on it to help her out with it and make things a little easier for.

Strangely im having to do something similar as i left and she stayed in the house with the kids and probably the affair-ee now! Sad FFRR MY06 facelift With TDV8 Alloys Zeros/ATR's

Lolo do not be afraid to defend yourself, espeically if your able to justify that it would put you at a financial loss more so than the other party.

Im DIYing and its saved me a fortune but has not changed how things would have progressed based on how useless the othersides legal help is! FFRR MY06 facelift With TDV8 Alloys Zeros/ATR's
