2008 L322 HSE Not starting

Hi, wondering if anyone can shed some light on a non start issue on a 2008 HSE 4.4, starter engages spins the engine over but wont start, the comfort start just keeps whizzing the engine over, IID tool came up with B1101-73 (2Cool comfort relay-mechanical failure-actuator is stuck closed.
Google has not thrown up much on this so this so the question is where is the relay/actuator located as I cant find it, starter works fine, battery volts fine so am scratching my head a little any help gratefully accepted.

Did you ever fix this I have a similar issue starts second time round every time with the same code Current stable:
2006 BMW M6
2007 4.2 V8 S/C FF

2002 4.4 V8 FF

Fuel system related failed non return valve on pump was letting the fuel from the line seep back in but cranking a couple of times filled the line up Current stable:
2006 BMW M6
2007 4.2 V8 S/C FF

To be honest different engine I know but I was lucky enough to have been donated a spare fuel pump (used but working) so I did it myself time consuming but not costly Current stable:
2006 BMW M6
2007 4.2 V8 S/C FF
