The diesels these days work by either injecting an additive to raise the temperature of the DPF or they simply do post injections just as the cylinder is about to do its exhaust stroke so you get fresh diesel in the exhaust again bringing the temperature up. this is then meant to be done for so long as to burn the nasty stuff off when it reacts with the precious metals in the DPF.
To be honest I don't believe they have done anything wrong, they have merely made their cars so that they pass government tests. That's what they want isn't it? If not then they need to do more realistic driving on the tests..
If they get rid of the DPF, EGR and such stupid things the engines could be more powerful and be made to burn more cleanly, the same for petrols in some respects. FFRR MY06 facelift With TDV8 Alloys Zeros/ATR's
