Thanks for all the help, definitely the RH EGR valve, the plunger on the end of the shaft has come off and was just laid in the gap to the cooler, all back together now, replaced both with new units, at a guess it took me about 8 hours in total, that was being very cautious and making sure everything was removed and put back together systematically, the biggest pain as mentioned above was the lower nuts on the injector covers.
Some numpty had been in there before unfortunately and broke a lug off the plenum, and the RH EGR had a broken bolt left in!!!
As a final note to help anybody else in the future the right hand exhaust was very smoky and if you pulled the inlet hose of the throttle smoke was coming out!! 2007 TDV8 VSE
